Property Development

Property development needs careful planning from the outset, since even the most straightforward projects can prove a minefield.  You may need access over a neighbour’s land, or a visibility splay for a new road; there could be covenants on the title restricting development or difficult planning conditions to address.  It is essential that all aspects are thoroughly investigated and managed with comprehensive, clearly worded agreements so that you know what you are acquiring and what you are able to develop.  Only then can you be sure that full value can be achieved.

Elliot Mather has a long history of involvement with development projects from small housing sites to major commercial/mixed developments.  We will assist with the formulation of initial strategies, detailed title investigation and the preparation and completion of contractual arrangements including conditional purchase contracts, options, forward funding or project management agreements, bank or other funding documentation and construction contracts.

We apply a proactive approach to our work for property development clients, with services relating to both residential and commercial developments that include:

  • Site acquisition
  • Planning issues - including advice on planning applications and existing permissions, planning obligations, infrastructure agreements and acquisitions subject to the grant of planning permission
  • Development issues - including development contracts for freehold or leasehold disposal, construction contracts and collateral warranties
  • Environmental issues - including advice on investigations required and your obligations under the relevant environmental laws.
