Our expert team are able to offer friendly and professional advice, with continuity of representation throughout your case. We can also assist with employment law advice if required.

Whatever the circumstances, if you are arrested or questioned by the police, it is vital that you have professional legal representation as soon as possible. Do not speak to the police without having representation. What is said and done in an interview often determines whether you will be charged and could affect your defence.

What is theft defined as?

Theft is defined as the dishonest acquisition of property belonging to another individual or individuals, with the deliberate intention of permanently keeping this from them. Whether this can be considered to benefit the accused or be a gain to them is irrelevant, if a deliberate act is committed, this is considered theft and can lead to prosecution.

What are the sentencing powers for theft from an employer?

If an individual has been found guilty of theft from an employer, the maximum custodial sentence for this crime is 7 years. However, it is vital that if you are accused of theft from an employer that you seek legal advice from an expert criminal defence solicitor as soon as possible.

What are your rights at the police station if you have been accused of theft from an employer?

If you have been arrested by the police on theft charges, or asked to attend an interview, it is vital that you seek legal advice from an expert criminal defence solicitor, or an accredited police station representative. Getting a solicitor is not a sign that you are guilty of anything, it is the sensible thing to do.

It is important to note that when you have been detained by police, you have the right to:

  • Be aware of the charges brought to you.
  • Remain silent until your criminal defence solicitor is in attendance in the interview.
  • Only answer police questions once legal support has been offered to you.
  • Have parental support if you are a minor.

In this instance, an experienced Criminal Defence Solicitor will be able to advise you on all of your rights in the interview.  Advice, in person or on the telephone, is free of charge from a solicitor when you are interviewed under caution with the police.
