Lasting Power of Attorney

Have you thought about how you would manage, if you were unable to communicate your wishes?

As we are all living longer, sadly ill health and mental incapacity is becoming increasingly common.

It is not just a problem for the elderly, as an accident or a stroke could reduce anyone’s ability to communicate.

You can prepare for such an event by preparing a document called a ‘lasting power of attorney’.  This enables you to appoint someone that you trust to manage your affairs for you, if circumstances change and you became unable to do so yourself. 

There are two types of lasting power of attorney:

  • Property and Affairs Power -  this gives power to your attorney to make financial and business decisions on your behalf.  They will also be able to deal with your property.

 

  • Personal Welfare Power – this gives your attorney power to make decisions about your health and personal welfare.  This could include decisions about where you may live, care provision and medical treatment that you are happy to receive.  (This is not the same as a living will – see separate section).

We recommend that all our clients prepare a lasting power of attorney to ensure that their wishes are clearly set out for their later years
