Grandparents Contact with Children

When parents separate it can often mean contact breaks down between a parent and their child which then in turn can mean grandparents lose contact with their Grandchild.  Children have a right to see parents (as long as it’s appropriate) and this is also the case for extended families.

What are your options

  • Grandparents are to request contact via a solicitor: they would also be able to attempt mediation to ask the parent(s) to spend time with their Grandchildren.  Mediation would be both parties getting together with an independent third party to discuss arrangements in relation to the child.  If neither option is successful they would have to consider an application to court.  
  • Grandparents can seek contact with grandchildren at court:  however they do not have an automatic right to make an application to court in respect of a grandchild, they have an additional hurdle to jump which is to get leave (permission) of the court. The court have a specific criteria to consider with the welfare of the child being top priority. They take into account:
    1. The nature of application the grandparents are making to the court.
    2. Their connection to the child.
    3. Any risk of application being harmful to the child or the family.
